These Terms and Conditions govern your use of the Forte Web Design website and any services provided by Forte Web Design to you as a client. By engaging our services or using this website, you agree to these terms in full.
Forte Web Design is a web design and digital marketing business operated by John Anderson, trading as a sole trader / family trust.
Forte Web Design provides website design, website development, and digital marketing services including search engine optimisation (SEO) to businesses and individuals, primarily in Hobart and Tasmania.
The specific scope, deliverables, and timeline for each project are agreed upon in writing prior to commencement. Any work outside the agreed scope may incur additional charges.
All projects commence upon written agreement of scope and acceptance of a quote or proposal. Verbal agreements do not constitute a binding commitment.
Scope changes requested after a project has commenced will be assessed and, if accepted, quoted separately. Forte Web Design reserves the right to decline scope changes that would materially alter the agreed project.
The client is responsible for providing all required content (text, images, logos, branding assets) within agreed timeframes. Delays caused by the client may affect the project timeline without affecting payment obligations.
Payment terms are specified in the project quote or proposal. Unless otherwise agreed in writing:
All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. GST will be added where applicable.
Due to the bespoke, time-intensive nature of our work, all payments are non-refundable once work has commenced on the agreed scope.
If a project is cancelled by the client after commencement, any work completed to that point will be invoiced at the applicable hourly rate or a pro-rata portion of the project fee, whichever is greater. The deposit is non-refundable in all circumstances.
If Forte Web Design is unable to complete a project due to circumstances within our control, a fair and reasonable refund of amounts paid for uncompleted work will be provided.
Upon receipt of full and final payment, the client receives full ownership of the completed website and all bespoke design assets created specifically for their project.
Until full payment is received, all work product remains the intellectual property of Forte Web Design.
Forte Web Design retains the right to display completed work in our portfolio, case studies, and marketing materials unless the client explicitly requests otherwise in writing.
Third-party assets (stock images, licensed fonts, plugins, or frameworks) are subject to their own respective licences and are not transferred as part of the ownership handover. The client is responsible for maintaining any ongoing licences required.
Where Forte Web Design provides managed hosting or ongoing support services, these are provided on a month-to-month basis unless otherwise agreed. Either party may terminate ongoing services with 30 days written notice.
If a client elects to move their website to another host or provider, Forte Web Design will provide all necessary files and credentials within a reasonable timeframe following settlement of any outstanding invoices.
The number of revision rounds included in a project is specified in the project quote or proposal. Revisions beyond the agreed allowance will be charged at our standard hourly rate.
A revision is defined as a minor change to existing agreed content or design. A revision does not include redesigns, new pages, or changes to the agreed scope.
The client warrants that all content, images, and materials provided to Forte Web Design are owned by the client or that the client holds the necessary licences and permissions for their use. The client indemnifies Forte Web Design against any claims arising from the use of client-supplied materials.
The client is responsible for reviewing and approving all deliverables. Written approval (including email) constitutes acceptance of that deliverable.
Forte Web Design's liability to the client for any claim arising in connection with our services is limited to the total fees paid by the client for the specific project giving rise to the claim.
Forte Web Design is not liable for any indirect, consequential, or special loss including but not limited to loss of business, loss of revenue, or loss of data.
Forte Web Design is not responsible for the performance of third-party services, platforms, or hosting providers once a site has been handed over.
You may use this website for lawful purposes only. You must not use this website in any way that causes, or may cause, damage to the website or impairment of its availability, or in any way that is unlawful, fraudulent, or harmful.
